TRAINEESHIP TASKS

Tasks/responsibilities of trainee: to conduct legal research on the following topic and write a legal report presenting the findings of their legal analysis.

Topic: Legal aspects concerning the establishment and application of territorial use rights in fisheries (TURFs) as part of fisheries management in Greece

Context: Territorial use rights in fisheries (TURFs) have been used as a tool in fisheries management for improving management efficiency and fishers’ livelihood. They mainly form localized exclusive sea tenure rights on fisheries resources in contrast to fisheries management relying on common property notions and open access. The potential application of TURFs in Greece is a matter of contention, and further research is required to understand the nature of these rights and evaluate the legal implications of their establishment and application as a tool to enhance fisheries sustainability in Greece.

Scope of research: The research and analysis will include the following aspects:
 What TURFs are, TURFs types/forms and key characteristics
 How TURFs have been established and applied in other countries’ legal framework
(beneficiaries, relation to specific types of fisheries (ie small-scale), recognition of sea
tenure rights, spatial application (ie relation with Marine Protected Areas), management
mechanism and processes, legal requirements etc),
 Examination and analysis of TURFs in Greece (ie different forms of TURFs already
recognized in the law)
 Assessment of possible avenues/scenarios for TURFs’ implementation in Greece (ie
appropriate forms/types, constitutional and other legal constraints, potential required
legal changes, legal requirements for their establishment and application etc).

Methodology: Literature review and legal analysis of the legal framework in Greece and certain other (EU and non-EU) countries (identification of the countries whose legal framework on TURFs will be analysed will depend on the findings of the literature review).

Deliverable: Legal report containing the findings of the legal analysis as described above
